The FCPA Blog goes ‘Above the Law’

We spoke last week with Zach Abramowitz, a columnist for Above the Law. The topic was the DOJ's failed attempt to extradite Ukrainian oligarch Dmytro Firtash from Austria.

The DOJ charged him and others in an $18 million bribe plot to win mining rights in India.

A judge in Austria said last month the charges were politically motivated -- Firtash is a pro-Russia Ukrainian -- and he accused the DOJ of fabricating testimony.

Fighting international graft on the theory that no man is an island fails to support the principle of extraterritoriality vainly asserted in the cases Dmytro Firtash and Viktor Kožený. Future attempts to prosecute foreign nationals for their transgressions on foreign soil would be better served by Team America: World Police, than futilitarian asseverations of U.S. jurisdiction.
