Bourke's last stand?

A federal appellate court Tuesday denied Frederic Bourke's request to rehear an appeal of his 2009 FCPA conspiracy conviction.

Bourke has been ordered to begin serving his one-year prison sentence by Friday (May 10).

Last month, the U.S. Supreme Court also refused to review Bourke's conviction.

A federal judge has recommended that he serve his time in a minimum security facility near Denver.

Bourke, 67, lost two earlier appeals to the Second Circuit Court of Appeals.

He had most recently asked the appellate court to rehear one of those appeals.

On Tuesday, all of the judges from the Second Circuit denied his request for another review.

Bourke has been free on bail since his 2009 conviction pending exhaustion of all his appeals.

He's now listed on the federal Bureau of Prisons website (Registration No. 58333-054). But at the time of this post he was shown as 'Not in BOP Custody.'
